Legal Question in Traffic Law in South Carolina

traffic case failure to appear

I was pulled over for a suspended license due to non payment of ticket. the officer charged me with a dus2 or dus 3rd general sessions offense. The department of motor vehicles stated that this was the wrong charge on my license and never chagred me on my license for said offense. Was charged for dus1 magistrate level offense. General sessions still put a failure to appear eventhough no general sessions offense. This failure to appear only shows up when rap sheet is ran. I've been pulled over twice within this 12 year period and the charge doesn't appear. What should I do to vacate this warrant or charge not a warrant because when i called the police station they stated that i don't have a warrant How do I get this off my rap sheet? I neeed to take nursing boards and they will not let me if appears. help

Re: traffic case failure to appear

Your question was, "How do I get this off my rap sheet?" In all honesty, everything else was confusing and hard to follow. The best I can figure is you have a Failure to Appear or a DUS that you want off your criminal record. There is a process for expunging certain items from a record. You can contact your county Solicitor's office. They are the ones that process the requests. Some people are able to do it without the assistance of an attorney. You can try it yourself to save some money. If you have problems, then you can retain the services of a lawyer. When you call the Solicitor's office, be sure to verify that what you are seeking to have expunged, can be done. Good luck.
