Vehicle Homicide
If a person falls asleep while driving and kills someone, what crime can they be charged with, if any? And is it mandatory or is it case by case.

They could probably be charged with Reckless Homicide and possibly under one of the Manslaughter statutes. You didn't say whether the person was under the influence of anything or not. That could have a bearing. All accidents, deaths, etc., are investigated and prosecuted case by case. Do you know some one that has had such an accident? Respond to [email protected]
