Legal Question in Workers Comp in South Carolina

My husband had a crush injury at work and besides his injuries that are healing he has loss his normal vision in one of his eyes and it will never come back. How do we make sure we get a proper monetary settlement. What is the value put on an eye?

I am sorry to hear about your husband's injuries. Your question raises a lot of issues. It sounds like your husband suffered injuries to more than one body part. If so, he may be able to recover for the permanent disability to each body part, or alternatively, he may be able to pursue a Loss of Earning Capacity claim. There is no way to provide an estimate of your husband's potential recovery without knowing all the body parts injured, the extent of his recovery, how much your husband was paid, and several other factors. You should really speak with an experienced workers' compensation lawyer in your area. Eye/vision claims are especially complex because most eye doctors are unfamiliar with the method the SC Workers' Compensation Commission uses to determine vision disability. Also, an experienced workers' compensation lawyer will help protect your husband's potential Social Security Disability benefits from offset by workers' comp. I hope this helps.
