Re: Impairment Rating
No. If you have permanent short term memory loss, then you have suffered some brain damage. Brain injuries result in a more swift deterioration of your cognitive abilities over time. Additionally, short term memory loss significantly reduces the type of employment you can perform, if any. You should seek the assistance of an experienced workers' compensation attorney immediately. I would recommend that you go to lawyers.com or bestlawyers.com and look up a lawyer in your area that focuses on workers' compensation and is highly rated by one of those websites. Brain injury cases are very complex, but you should be entitled to significantly more than 5%. Oftentimes brain injury cases result in awards of more than the typical 100% award. Re: Impairment Rating
I'm not sure if it is or not. I would have to review the medical records. The last time I dealt with a case where there was a head injury, I was able to prove brain damage which made a very significant difference. The medical reports are truely the key to achieving a favorable settlement.
