Legal Question in Criminal Law in South Dakota

Relinquishing court documents to parties involved

I was assulted by my father and believe that the case was handled incorrectly and mistakes were made. I contacted the DA and he refused to release any court records or anything, stating that it was a ''policy'' they had not to release any records. Is it a policy or do they, by law, have to release the records to me?

Re: Relinquishing court documents to parties involved

Thank you for your posting and your inquiry.

There is a separate criminal code, (actually part of the California Penal Code) that prevents release of sensitive information to third parties, or even certain information to defendants themselves.

You can get this through an attorney, or through a subpoena, if you can convince a judge after motion that good cause exists for its release.

I hope that this information helps you, but if you have further questions, want more information, or feel that you need legal representation, please feel free to email me directly at [email protected]. It's my pleasure to assist in any way that I can.
