Legal Question in Family Law in South Dakota

I filed for divorce on 1-8-99, I have since met someone I want to be with. If my divorce isn't final is it still considered adultry if i want to move in with her and live with her.

Sexual intercourse with a person who is not your spouse is adultery if you are

married. It doesn't change if you are seeking a divorce, you are still married.
