What do I need to do to get my son back?

My ex and I have a divorce decree through ND. In that order we have joint legal custody with myself having physical placement. My ex has a specific visitation schedule outlined in the order. I let my ex take my son temporarily to SD while I relocated to NJ and got settled thinking it was in the best interest of my son. My ex is now refusing to return him with nothing filed with any court changing the divorce decree. He just petitioned the court in SD where he resides to give him an ex parte emergency custody order. The clerk said it has not officially been filed yet. Is there a form I can file quickly that will guarantee my child be returned? I contacted the local police department and they said they would not be able to arrest me if I went and took my child. Since I have an order proving I have custody/placement. What can I do?

you have a huge and nasty problem. get to a lawyer, and then RUN to court.
