Legal Question in Landlord & Tenant Law in South Dakota

Need out of lease

My husband and I rented a home sight unseen. He had accepted a position in another state, and I was assiting my family in yet a third state. He signed a year long lease. Now that we are here, we are finding that this house will absolutely not work for us. We would like to give the landlord 60 day notice that we are backing out of the lease, and offer assistance to re-rent the home. How obligated are we to legally remain, if we would end up being miserable, and if we can find a renter who would enjoy what this home offers?

Re: Need out of lease

Need to review lease to advise.

Generally, without a restrictive provision you would be able to sublease to a qualified tenant for balance of term.

I have 25 years experience in LL Tenant law.
