Legal Question in Disability Law in Tennessee

Blank Check

My daughter was given a signed blank check by a lady she worked for to pay for her childrens christmas, The lady was in poor health at the time and died suddenly afew days before christmas. My daugther went ahead with the plans the made by cashing the check for christmas presents. Now the the Ladies Step Daughter has closed the account even after the check was approved for payment and is trying to bring charges against her. Where does my daughter stand in this matter and what steps need to be taken.

First question is does your daughter have proof that she used the money for presents for the woman's children? If so, then she probably did not steal or convert anything. Although technically, once the woman died any authority she had given your daughter vanished, your daughter probably would not be found guilty of doing anything wrong provided that she used the money for the woman's children. In this situation, I would recommend talking to a lawyer before charges are brought. This will enable your daughter to make sure her evidence is in line before it is needed.
