Pension Discrimination

I have been on permanent disability leave from my company since 1981 due to a car accident.

My pension is vesting each year however I recently learned that all employees were offered the opportunity to change their pensions to a 401k several years ago.

I was not offered this opportunity.

The company has over 4000 employees and I believe I was the only executive employee not offered this benefit.

Do I have a recourse as my pension would be worth a great deal more if I had been able to change to a 401k plan.

Based on the facts you have alleged here, it appears that you indeed have a cause of action. For some reason your suffered adverse discrimination and were not given the opportunity to convert to a 401K. Does your former employer show any interest in doing the right thing and giving you that opportunity now?
