Questions

When You file for Bankruptcy does your Banker and Employer find out about the bankruptcy ?

I have over $ 47,000.00 in unsecured credit card debt, have lost my job and over $ 1,000.00 in monthly income.

Re: Questions

Depending on the type of bankruptcy you file, your employer may or may not necessarily discover the filing. However, it is more likely that your banker will know of the filing for a number of reasons, not the least of which is many bankers watch that type of information.

Exactly which bankruptcy chapter you should file under is something that can only be determined after you speak with an experienced bankruptcy attorney. I know a number of good debtor bankruptcy attorneys in the Shelby County, Tennessee area and would be happy to put you in touch with one if you contact my office.

Re: Questions

Short answer -- You would file under Chapter 7.

Your employer does not need to know about your filing. Your bank would possibly have to know if you have current loans with them. If you don't have any loans with your bank they will not receive notice of the bankruptcy filing. Please feel free to call me toll free to discuss your questions in more detail.
