Legal Question in Bankruptcy in Tennessee
Return of Funds Earned
My husband was a manufacturer's rep. The company he was a rep for declared bankruptcy. They owed him $7,000. Now the bankruptcy court has filed a suit to have him return the money they paid him for the 6 months prior to the bankruptcy filing. He provided a service for that money, plus he had expenses to get the business. Does he need to return the money??

Re: Return of Funds Earned
It depends on the reason why the funds were paid. If the funds were paid because of a preexisting debt owed to your husband, then it will probably have to be repaid. Otherwise, it may not.
