Legal Question in Bankruptcy in Tennessee

My tax refund

I wanted to know if we filed for bankrupcy in late february ,2006 , would we lose our 2005 refund ? We usually file early and get it back around the second week in feb. We have at least 80 grand in debt and no jobs . We can't afford to file without our refund. Thank you .

I think you meant your 2006 refund and Feb 2007; the answer is NO not necessarily. A married couple is allowed to keep $8,000.00 of assets including cash. So the answer depends on the amount of refund you expect to get, your present, and debt.
