Legal Question in Bankruptcy in Tennessee
Wage Garnishment
I just received (11/26/07) a judgement in Civil Court for back rent owed me from a tenant I legally evicted in October. I just found out that the Tenant had filed Chapter 13 in 05/07. Can I proceed with a garnishment action in light of this Chapter 13 filing?

There is a stay, you needed to file a proof of claim. with the chapter 13 trustee, but you may be too late because the creditors meeting may have passed. This judgment can be reversed because they were in a bky and if you were aware and did not disclose to the court then you have violated the stay
