Legal Question in Business Law in Tennessee
Duplicate/identical business names
Hello,
I would like to name my horse farm a particular name and have just learned there is another farm in a neighboring state, Mississippi with the same name. What does the law say about this? The other farm is an LLC and at some point that is what we would set up for our farm. The other farm is also a horse farm.

You cannot name your farm in such a way as it might confuse people. If your name could be confused with the other farm you may be in trouble. Since you are in different states you might have some room to maneuver. I suggest a different name to avoid all problems. If you need any help please feel free to contact me.
