Legal Question in Business Law in Tennessee

Home Day Care

I am planning on watching 3 children in my home Monday - Friday for working parents. I have devised a short parent handbook for the parents with details of fees, meals, schedules, etc..... I would like to add a disclaimer for the parent to sign agreeing to the terms in the handbook and also to acknowledge that they are aware that I am not conducting a business, merely providing babysitting services for them. It is there responsibility to check with their accountant to see if their child care expenses are deductible. I do not plan on getting a business license. Is this o.k.? What is Tennessee law regarding home day care? Do I have to provide the parents with my SS# for tax purposes?

Re: Home Day Care

Your questions have more complexity than can readily be answered in this type of setting. However, you will need to provide your SS# to the parents for income tax purposes, but you probably do not have to check with any accountant about the deductability of any of the payments. (Except for your own accountant). Check with your County about applying for a business license. For the State, I believe (but am not 100% certain without some research) that the limit is 5 children before you have to register as a day care provider.
