Legal Question in Business Law in Tennessee
Misrepresenting a business as another through business name association
I have a company in which my manager resigned and opened a new business with a very slight change in the wording of the business name. All advertisements look the same as mine and the advertised name is no different from my business. They also contacted my customers and told them there was going to be an address and phone # change but nothing else. They also took files pertaining to my business. Do I have any chance of legal recourse due to the misrepresentation of that person's new business as my business? I am pursuing criminal theft charges on the business files that were taken and would also like to take any other action I could to stop this from destroying my business.
