signing a no compete
I signed a no compete when working for a telecommunication company. Then resigned some time later. THen worked at another company for 1 year. Then came back to the previous company and since have been working there for 3 years without signing anything. I am in telecom sales. Now he wants me to sign. My question is: Is the previous contract valid? Or was it void when I resigned? Will I receive a Cease and Desist Letter if I contact my contacts made through my dealings there? Do I have any reprucussions if he sues me for not ceasing and desisting?

Your previous noncompete is most likely invalid. However, the reasons for its promulgation (e.g., the protection of trade secrets) may still exist. If they do exist, then it may be that you are bound by common law doctrines which would prevent you from using that information. With that being said, the common law restrictions are much less restrictive than typical noncompete law.
