Specific purpose defective product

I bought spas from Dynasty Spas in Tennessee and recieved a defective one which they will not take back or fix without me paying al charges. This is lack of specific performance for a particular purpose. I need help. This has put my business future in jeprody. I have tried verbal communication and written letters with no response.

Do you have money to pay for legal assistance or are you looking for free legal advice? You should check out the "Uniform Commercial Code." It sounds like you have grounds to sue the spa company for sending you defective merchandise. Of course, if it was damaged in shipment, then it may depend on which party assumed liability for potential damages from shipment.
