Legal Question in Business Law in Tennessee
Can a text message be use as a legal docoment, when someone threaten you with bodily harm
2 Answers from Attorneys
Laypeople often use the term "legal document" as if it means something. It doesn't.
Whether a given statement can be used in court will depend upon what it says, what it is being offered to prove and the surrounding context. It usually won't matter whether the statement was made orally, in writing, via text message or what have you.
If the text message contained a threat to harm you and you want to use it as evidence of that threat, then it will probably be admissible. Whether it actually will be will depend upon additional facts.
The other attorney is right on point here. A text message is evidence and can be used to prove a claim. Consult with a good attorney in your area for specific advice.
