Verbal Agreement

Can my daughter be sued by her music producer (ex-producer)? She has an investor in her music career and he said he would send $40,000 to do an album. He has not sent it and I don't know that he will, so she told her producer and he threatened to sue her if she didn't pay. She has no money! He has worked with her and taught her some songs (she paid him to teach her some guitar) over the past few months. She has helped in his office several times and helped with a music video shoot without pay for one of his clients.

They have not recorded any of the album. He has emailed and phoned my daughter but she won't answer and he again said he's taking her to court in Tennessee. Does he have a case? She did email him in August telling him her investor would be sending the money, but how can she be liable for someone else's money?

Based on the facts you have given, it is impossible to tell for certain. Generally, verbal contracts can be upheld in Tennessee. However, there may be a number of defenses to this action. If your daughter is faced with a real threat of litigation, it would be a good idea to get an attorney involved to help her with the situation. It is usually a bad idea to ignore this type of situation.
