my brother is in the 8th grade and has decided to become an aetheist.he chose not to stand up for the pledge of allegiance and when his teacher asked why he told her it was against his religion,he was given detention.isnt this unconstitutional?

There are international cases, wherein such actions has been declared to be unconstitutional. But in your case, your brother did not stand up because he beleived in aetheist, which is no religion, and hence because of his personal arrogance and ego he refused to do pledge, which is not in a religion. Hence if detention is made on that ground, it is not unconstitutional.
