Legal Question in Consumer Law in Tennessee
I want a refund!
In july 07, I put a deposit of $3000
on an engagement ring so that the
store could hold it for me till I was
able to go back to get it. However,
with my hectic work schedule, i was
not able to go back right away. In
sep 07, a couple of days ago, I called
the store and told them that i didn't
need it anymore and that I wanted
my deposit back. They told me that I
could not get it back because it was a
lay-away and that I had defaulted on
their 30 day lay-away policy. I was
given the option to spend the money
in the store, but I don't want to. I
just want it back. When they asked
for a deposit, I was told that it was to
keep the ring in the store so that
they would not sell it to anyone else.
I did not ask for a lay-away with the
intention of making monthly
payments. Nor is that info explained
on the reciept that was issued to me.
Please help with some advice if you
can! Thanks!

You (or an attorney) should send them a demand letter requesting the return of the $3000. However, it sounds like you might be obligated to purchase the ring since you put a deposit on it to hold it in the store. You need to find out if the deposit was refundable. If it was, then proceed to small claims court if they refuse to give you your money back.
