Legal Question in Credit and Debt Law in Tennessee
Air Force Scholarships
Does an Air Force Scholarship Award qualify as a debt or a loan? My son-in-law was refused a commission after graduating from a leading university due to being (1 lb.) over weight limit. Now they want their $70,000. of tuition expense back. Hard to believe but, true. Since this was not a student loan for which he applied but a scholarship ... is bankruptcy an option? The attorney fees to fight the unfairness and stupidity of all this are eating him up. He is ready to put the issue behind him and move on. What are the options available?

Re: Air Force Scholarships
He has to have a lawyer read the terms of the scholarship to determine what his liability is. Don't try to guess on this and hope for the best.
If he cannot afford a lawyer, he should go to Legal Aid. Most bar associations also have a panel of lawyers willing to work for reduced fees.
He may also have a claim against the air force for refusing to accept him, on fair employment - unfair discrimination grounds. Again, only a lawyer can give him proper advice, after reviewing the facts in his particular situation.
Good luck!
