Legal Question in Credit and Debt Law in Tennessee
Collection agency made a settlement agreement with me then sent me a letter before the agreed date to pay stating that I didn't uphold my end of the agreement and that I now owe the full amount. Now they are taking me to court for the full amount. What can I do? I have both letters...the settlement agreement and the letter stated above.
1 Answer from Attorneys
It is always difficult to give a specific answer when I cannot see the documents. However, I would try to deal with their attorney to resolve the situation if they violated their agreement with you. If I represented the creditor I would want to know if they had an agreement with you and would advise them to settle it if they violated that agreement. If they sue you, then you either need to hire an attorney, or defend yourself.
