how far can creditors go to make your life miserable
I recieved my credit card in june of 1997, it is now 2004 they sent the police to my parents houst to sipina me to court. I called and he said he would take a settlement of 800 dollars more then what i spent by the end of the month, then he sent me a letter saying i only have 10 days I called but he wasnt in and hasnt called back should i let him take me to court and see what the judge says. I am a single mother with 3 kids and we will be laid off work here in 2 weeks . what should I do I dont know which way to turn?

If you owe the money, then you have to pay it barring any bankruptcy filing. You may be able to work out some type of payment plan, or the court may impose one. In order to get the court to impose one in Tennessee, you have to first have a judgment against you, you have to be the subject of a garnishment, you have to file a Motion to Set Installment Payments, then you have to show up at court with proof of your income and expenses. This is a lot to go through if you can work out some type of payment plan on the front end. From your description, it does not sound like the attorney has committed any violations of the law, but you may want to discuss your situation in more detail with an attorney experienced in handling Fair Debt Collection Practices Act cases.
