Paying Compensation when you are an uninsured motorist

My husband with no insurance had a collision upon turning left at a green light and was hit by a vehicle which had no insurance either. Our van was totalled and the other vehicle had front end damage, no people were hurt in their vehicle. we were fined for failure to yield and no insurance. we recently received a phone call from them to say it would cost $5000. to repair their truck. Are we legally obligated to pay this? We own a home (mortgaged)and our church donated another vehicle to us which is in my name not my husbands. If we agree to a payment of $30 a month do they have to accept? this is all we can afford right now.

If your husband was at fault in the accident, then he will have to pay for repair of the other person's car. Just because he got a ticket does not automatically mean he was at fault. You are not obligated to pay until a judge/jury says you are. Also you do not have to take their word for how much the repairs will cost. Ask to see estimates. Ask to see more than one estimate. If you reach a resolution make sure it is in writing and clearing spells out that you are paying money to settle the claim.

You should go see an attorney about this situation. Go find one in your local area. Pay a consultation fee if he asks for one, explain the facts of the accident and ask the attorney to help you out of this situation.
