Legal Question in Credit and Debt Law in Tennessee

Out of State judgements

I reside in Tennessee. If a Texas court puts a judgement against me, what are the consequences in Tenness? ie, can my house, retirement funds, physical property be attached?

Texas law doesn't allow the above.

Courts deal with substantive law and with

procedural law. If the judgment was transferred

from Texas to Tennessee, you would obviously

make the argument that the substantive law of

Texas where the judgment was originally obtained

should be the controlling substantive law of the

case. That is what is sometimes referred to as

renvoi - the Tennessee court looks to the substantive

law of Texas for its decision. However, you are dealing

with a very dicy situation that should be determined

by a lawyer who has all the facts of the case and

who can sit down with you in an office conference

where all the details of the case can unfold.
