Legal Question in Credit and Debt Law in Tennessee
ID theft
My husband was a victim of ID theft in July and we filed all necessary paperwork with law enforcement, FTC, IFCC. He has payday loans and due to the id theft, we were advised by the sheriffs department and the FBI, that we were to close our checking account as soon as possible. We closed the account on the 28th of July and contacted all online payday loans of the situation and faxed proof of the id theft. Some of the companies have forgivin the debt, but some have called and stated that he would be arrested if twice the amount wasn't received. They are unwilling to cooperate. The officer who took the report has called the places and informed them of the situation and they keep harrassing him at work and at home. We were told by the sheriffs deputy that as long as it was an open police report, that there is nothing the payday loan companies can do. The ones that are still harrassing, have no license to do payday loans in the state of Tennessee or the state that they claim to be out of. What is our options to put a stop to these people?

You can file suit against them under the Fair Debt Collections Practices Act. You should research that act on the Internet and decide where you believe it has been violated.
