Legal Question in Criminal Law in Tennessee

allegations of official misconduct

I have a friend who was accused of allegedly having sexual contact with an inmate. During the investigation they told him he was being accused of rape and he was asked to submit to a polygraph. Then a few days later they said it wasn't rape but was being accused of sexual contact. He did submit to the polygraph, but it didn't prove his innocence. Aside from that there is no evidence except the inmates word against his. He states he is innocent and never touched the inmate. Can the polygraph alone be used against him in court?

Re: allegations of official misconduct

In New Jersey the results of a lie detector test can only be used in a trial where the defendant and State of New Jersey both agreed BEFORE THE LIE DETECTOR TEST IS DONE that the test would be admissible during the trial. You can call me if the case is in New Jersey.
