Legal Question in Criminal Law in Tennessee
is an attorney needed to have disorderly conduct charge thrown out?
I was arrested for disorderly conduct, I feel in error. I was also charged with resisting arrest, although I don't know how it could be categorized as such when I was literally jerked from the door of my home and pulled to the police car. I am a school teacher and am concerned about any type of permanent record. Do I need an attorney to help get these charges expunged?

Re: is an attorney needed to have disorderly conduct charge thrown out?
Yes, you DO need an attorney, but not yet for having the record expunged -- first you have to go to court and defend the charges against you. I know that you may think you really don't need an attorney because you are innocent and the charges are never should have been filed in the first place. BUT THEY WERE FILED. Now, if you fail to defend against them properly you will end up being convicted, and ther you can forget about ever expunging the matter from your record. One thing you need to know is that NO ONE LIES IN COURT AS OFTEN AS POLICE. The cop charged you -- he is not likely to come into court and admit he should not have charged you, and if he says you were doing as he charged, and you deny it, who do you think the judge is going to believe? Get an attorney now. Do not hesitate.
