Legal Question in Criminal Law in Tennessee
Bench Warrant
I have a bench warrant for my arrest due to a
missed court date.
I had a judgement filed against me from an
apartment complex and I filed a motion to set
payment arrangements...that appearance was on
March 24, 1999.
In the meantime I decided that Chapter 13
would be best and that was made official on
March 17, 1999.
Since the judgement was included in the
bankruptcy I thought the court appearance
would automatically cancel out.
Is there any way to stop the bench warrant
and arrest process?

Re: Bench Warrant
In most courts in Tennessee if a person appears in court with an attorney (and a good explanation) after a bench warrant is issued, the judge will recall the bench warrant without requiring an arrest.
