Legal Question in Criminal Law in Tennessee
Chapter XIII and bad check law
39-14-121 states that a state or individual may not prosecute under the bad check law for a debt discharged under chapter XIII. I have this situation due to my business closing, however they are pursueing felony charges aganist me. QUESTION: What is my legal right and can they do this?

I believe that statute means that the check cannot be collected upon. I do not believe that the statute means that you cannot be prosecuted if you committed the crime of passing a bad check. If you are not guilty of writing a bad check and someone has taken out a criminal charge against you trying to coerce you to pay the check, you may have a very good civil lawsuit back against the person who is charging you with the crime.
