Legal Question in Criminal Law in Tennessee

Drug charges with no drugs.

I was pulled over and searched. In the trunk they

found a shopping bag w/ plastic bags and the aroma

of Marijuana...no marijuana.I'm being charged with

simple possesion. I was never asked if my car

could be searched. He said it smelled like pot..no

one else could smell it.. What can i

The best thing to do is simply to get an attorney who knows what he is doing.

While it is impossible to ever now any absolute certainty what is going to happen when you walk into a courtroom, if the evidence at trial were the same as what you mentioned I would be shocked if one of my clients were convicted.

The key in your case will be in handling it properly, but if handled right the charge should be dismissed very quickly.

Additionally, if handled properly you can probably get two shots at getting it dismissed, having it tried in Sessions Court and then appealing it to start over to get a trial before a jury if a Sessions Court judge is so foolish as to convict.
