Legal Question in Criminal Law in Tennessee

Drug possession

On July 11th, my son was pulled over for speeding and was found in possession of pot and a glass pipe. He is 19 years old and never had anything more serious than a speeding ticket. Is this something that will stay on his record forever or can that be avoided?

Re: Drug possession

If he was given the ticket and the citation in Tennessee, that makes it a question of Tennessee law and I cannot answer it.

I assume that these were both charged as misdemeanors. If either results in a felony conviction, that cannot be expunged in Kentucky.

And note that a second conviction of Possession of Drug Paraphernalia (the glass pipe) is a felony offense.

In Kentucky, misdemeanor convictions can be expunged after a period of time. This requires going to District Court and filing to expunge the record. Any local attorney should be able to help you with this.
