Legal Question in Criminal Law in Tennessee
Expungement of shoplifting conviction
A year ago I conveyed extreme stupidity and stole a
Playstation controller from a store (shoplifted).
Well, a year before I had to go on probation because
of someone leaving a crumb of pot in my car (simple
possession). My question is this: Can I have the
shoplifting conviction expunged from my record? The
shoplifting and possession where in two different
counties. I am now currently serving an unsupervised
probation period
of 11 months, 29 days for the shoplifting while the
probation tenure for the simple possession had been
successfully completed the year before. I never went
to expunge the possession charge. Would that be
possible as well? Even though it's 2 years in the
past? Any information would be greatly appreciated.

Re: Expungement of shoplifting conviction
In a case I presented to the Tennessee Supreme Court several years ago which directly addresses your question, I would have to say you are not eligible for expungment. For further info, see www.gsmithlawfirm.com
