Legal Question in Criminal Law in Tennessee
What's right?
My husband was arrested and held without access to a phone or lawyer for two days, and then the court decided to charge him, and they waited three more to arraign him. He had no bail set before the arraignment and no lawyer during questioning. He's being charged with theft over $1000 under $10,000, but it's a false charge. We're wondering what, if anything, is being done wrong.

The biggest problem that I see is the lack of an attorney present during questioning. This does depend, however, on whether your husband asserted his right to ask for an attorney. If he did, then they should not have questioned him without one present.
