You have asked two questions:
1 - Criminal Impersonation (T.C.A. 39-16-301) is already a misdemeanor, a Class B misdemeanor unless you are pretending to be a police officer, in which case it is a Class A misdemeanor.
2 -Most persons convicted of misdemeanors receive suspended sentences on supervised probation. Courts usually reserve jail sentences for repeat offenders or those who have a history of inability to comply with probation.
