mental retardation and criminal law
can a mentally retarded person that commits vilence against staff be declared incompetent after the fact and can her record be expunged?

The sole question on expungment is whether the person was convicted or not.
If the charge was disposed of with something other than a conviction (which includes a guilty plea), then it can be expunged. No convictions can be expunged.
