Legal Question in Criminal Law in Tennessee
misdemeanor theft
i was arrested on 11/10/99 for allegedly stealing
11.00 out of a vending machine that i had filled
as a part of my job duties for a soft drink
company. a warrant was signed on me. i was
taken to the police station and booked.it has come
down to my word against theirs. no money was found
in the polices search of me or the vehicle. i have
never been charged in my life for anything. my
question is twofold.what is the sentence for
misdemeanor theft under 500.00 and what are the
chances that a judge will throw the case out for
a lack of evidence.

If you have an attorney who is familiar with criminal law and is any good at it, the charge should be dismissed (unless there is more than you set out in your question), and you could probably even file a lawsuit afterwards for malicious prosecution.
If you are convicted, your maximum sentence for theft under $500 in Tennessee is 11 months and 29 days in jail.
