Legal Question in Criminal Law in Tennessee

My son is in prison in Tn.He was told by his attorney and assistant D.Aif he signed a nolo contendere he was not pleading guility and would only have to serve 1/3 of a10 year sentence.now,they tell us it is up to the state and what they told him doesn't mean anything.Is there anything we can do?
