Legal Question in Criminal Law in Tennessee

statutory rape

I want to know how old a female has to be for consentual sex with an adult over the age of 18. Also, if she has a baby and is the age of 17 is she emancipated, or is there any difference in the statue?

Re: statutory rape

The age of consent to have legal sexual relations with a person under the age of 18yrs depends on the age of the sexual partner. In Tennessee, if a person has sexual relations with a minor 13 years old or more but less than 18 years old and such person is 4 or more years older than said minor, the such person has committed the crime of statutory rape under TCA 39-13-506. This is true even if the older person is under the age of 18. Statutory rape is a felony and a conviction would require the perpetraitor to be filed with the sex offender regisrty for the rest of their life. Knowledge of the childs age is not required for conviction.
