Legal Question in Criminal Law in Tennessee
How much time will I get for 3 aggravated assault and false report
1 Answer from Attorneys
I can only tell you what the range of punishment is for the offenses you have recited:
Aggravated Assault - if "intentional or knowing" = Class C Felony = 3 ~ 6 years for a first time offender.
Aggravated Assault - if "reckless" = Class D Felony = 2 ~ 4 years for a first time offender.
False Report - if "non-emergency" = Class D Felony = 2 ~ 4 years for a first time offender.
False Report - if "emergency" (creates danger) = Class C Felony = 3 ~ 6 years for a first time offender.
If you are not a first time offender, then the range of punishment goes up, to a maximum of 15 years for a Class C Felony; a maximum of 12 years for a Class D felony.
And sentences can be consecutive (stacked) one on top of another.
So simply based on what you have asked, your range of punishment could be as low as 2 years (2 x Class D Felonies), concurrent;
of as many as 60 years (4 Class C Felonies as a Career Criminal x 15 = 60).
Obviously, there are a lot of unknowns in your question.
