Legal Question in Criminal Law in Tennessee
wrongfully accussed
my mother has been in and out of court since august of this year. she sold someone some furniture, and they never paid and she took them to court. she won, and they were really mad. on sept 5, she was arressted for criminal trespassing and stalking by the person who purchased her furniture, and her neighbor. they are both not true. she was never in their neighborhood. could she do something to them for false accusations? she has never been in trouble, now she has a criminal record. it's not right, how could they arrest her with no evidence. if they present no evidence in court, will they still win? please help she is scared and doesn't know what to do. thankyou

Re: wrongfully accussed
Your mom needs to hire an attorney. Sadly, a person can be convicted on false testimony. An attorney helps catch the other side in their lie. If your mom can't afford an attorney, the court can appoint one. Even though I'm a part-time judge and have practiced law, including criminal law, many years; if I had charges, I'd hire an attorney to defend me. For more info, see www.gsmithlawfirm.com
