Legal Question in Discrimination Law in Tennessee

My boss's wife is accussing me of an affair with him

I work for a husband a wife owned resturant and have been for 3 years.We started out as close friends all of us and about 8 months ago she accused me of having a affair with him.As a friend I thougt maybe she was having medical emotional troubles so I let it go.Things got really tough at work for about 6 more months then she finially started talking to me again.Three weeks ago a mad employee sent her letter throuh the mail and said I was talking to him on the cell phone and having sex with him in the bathrooms at work for money..which is not true by the way...She won't address the letter to anyone at work the husband told me that's why she was so rude to me lately that she had recieved the letter on my birthday at work.. two weeks later the same one we susected that wrote the letter is calling them and saying I am causeing more trouble and being mean to her.I just wont talk to her at all but am not mean nor rude.The wife is wanting to fire me now.But he won't let her.We know this girl is causeing trouble but the wife insist on the affair and is completly unreal to work for..I can't sleep,eat and my husband has been laid off of his job of 5 year last month so I cant afford to just quit my job I have two children..What do I do..

My first question is; How many employees does the resturant have? If it has less than 8 you may have some problems. Tennessee state employment discrimination law does not cover an employer with less than 8 employees. Federal law requires 25 or 50 depending on the type of discrimination.

If your employer is covered by the Tennessee Human Rights Act or the Federal Civil Rights law you could file with the EEOC or the Tennessee Human Rights Commission. You could also hire an attorney.

If your employer is not covered by those Acts you may have a difficult time doing anything legally. I would work to establish your own credibility as superior to your co-worker's. The best bet is to try to find another job before this situation gets out of control.
