A national service "fraternity" (no live-in houses) allows some chapters at universities to have all male (no female) chapters.Are their any federal rules (tax, etc) which would force them to have all chapters co-ed.The chapters have free usage of university facilities.thanks

There is all sorts of precedent covering supposedly private "clubs" and organizations which really, with the imprimatur of state law, discriminate. The key to liability is, among other things, whether or not substantial business is done at these organizations, which inures to the benefit of members professionally... I would need to know more to be more specific; if it is a public university, that helps; but even if a private one, the test is not what you call it but what it is in reality.
