After being given three FSTs, I was arrested and charged with DWI. After recent investigations on the case, the cruiser video of the tests on filmed from my waist up. On the report the cop said I put my foot down too early and didn't step heel to toe. Can this case be thrown out because the video does not show evidence of the cops observations?

It obviously mkes the case weaker for the prosecution, but it is not an "automatic" dismissal of the charges. More important will be the dashboard video of your driving, your voice, and of course the blood alcohol test.
