Legal Question in Entertainment Law in Tennessee

No Production Agreement

I finished recording an EP a few months ago with the intent to pitch it to major record labels. I did not sign a production agreement. If I were to get a record deal can the co-producer sue me or demand more compensation without an agreement? Or, am I obligated to pay anything since the recording is already finished?

Re: No Production Agreement

It certainly places the use of the recording in question. Without a contract, you and the producer are deemed co creators of the music and as such each has rights in the copyright. Additionally, I treat the person that paid for the recording as the owner of the master (not necessary the entire copyright). As co creators you have a duty to account to the producer if exploitation occurs - arguably at a rate more than would be in a contract. The best procedure is to get a producers contract so that all parties know their durties and responsibilities.

Let me know if we can help.

Good luck
