Abandonment? Husband keeps bringing this up

Hello I am forced to separate from my husband because of his destructive behavior (breaking things and yelling and occasionally pin me to the wall or other physical contact) and unwillingness to show up for marital counseling. I would really like him to leave so that I can stay near my 17 month old daycare. He keeps saying that I need to go to a lawyer and sign some papers saying he is not abandoning us. Is he trying to do something I dont know about and should I do this? Please help Ive never had to go through this. I have a feeling his parents have retained a lawyer already.

You could go get an order of protection possibly. Depending on the severity of the physical contact. Signing any papers without having them reviewed by a lawyer is risky.

His request is however reasonable. By him leaving he would be giving you a ground for divorce under Tennessee law, you might possibly have one for cruel and inhumane treatment already, but him leaving could for sure be used against him.

I highly recomend you speak to an attorney about this and have any documents it is proposed you sign reviewed.
