Not abide by an Agreed Order

In Tenessee, my aunt, uncle, and I have an Agreed Order about our Change of Custody with my son. They never followed the Order. With proof of failure to follow the Order, can I automaticaly get my son back? Or do I need to go through all procidures to retain Custody of my son? Do I need an Agreed Order form when I file the Petition for Change of Custody? Also I live in Florida and my son is in Tennessee.

You need to file a petition for contempt of court against the other party. At the same time, you can file a petition to change the parenting plan or other custody order you entered into. You will have to go to court to change your son's status.
